1. Plant Material Warranty

Plant materials installed by Dessens Landscape Architecture LLC (DLA) carry a 60-day warranty from installation, provided the property has a functioning irrigation system. This warranty covers defects in materials and workmanship only.

2. Warranty Exclusions

  • Annuals: Guaranteed only for the season installed. Not warranted against acts of God, animal damage, or lack of irrigation.
  • Non-irrigated areas: No warranty for plants in areas without functioning irrigation.
  • Weather: Freezing, flooding, wind, hail, drought or other adverse weather is not covered.
  • Theft/vandalism: DLA assumes no responsibility for loss due to theft or vandalism.
  • Relocation: DLA will mitigate transplant loss but cannot be held liable after relocation occurs.
  • Pests/fungus: Insects, fungus, mold or other biological conditions after installation are not covered.
  • Drainage: No warranty against flooding or erosion. Drainage designs should be reviewed by a licensed civil engineer at the client's expense.

3. Scope of Work & Additional Costs

  • This quote covers only the work explicitly described herein. Hidden or unforeseen conditions (underground utilities, buried structures, root systems) requiring additional labor or materials will incur extra charges. The client will be notified before any additional work is performed.
  • Changes or modifications requested during construction will be quoted separately and approved in writing via email, text, or signed document before proceeding.
  • DLA is not responsible for damage to unmarked underground utilities or structures not disclosed prior to work starting. The client is responsible for providing accurate property information.

4. Payment Terms

  • No work will begin until the first payment is confirmed received.
  • Failure to make timely payments may result in work stoppage. DLA reserves the right to charge 1.5% per month on overdue balances.
  • All payments are non-refundable once work has commenced, as materials will have been ordered and labor scheduled.

5. Project Timeline & Delays

  • Timelines are estimates and may be affected by weather, material availability, permits, or other factors beyond DLA's control. Significant delays will be communicated promptly.
  • Client-requested delays of more than 7 business days after the scheduled start may result in rescheduling and potential price adjustments due to material cost changes.

6. Client Responsibilities

  • The client must ensure clear and safe access to the work area on all scheduled work days.
  • The client must disclose locations of all underground utilities, sprinkler systems, septic systems, and other infrastructure before work begins.
  • Post-installation plant care (watering, fertilizing, pruning) is the client's sole responsibility unless a separate maintenance agreement is in place.

7. General Disclaimer

DLA shall not be held liable for indirect, incidental, or consequential damages arising from this agreement. This document constitutes the entire understanding between both parties. By signing, both parties confirm they have read, understood, and agreed to all terms. This quote is valid for 30 days from the date of issue.
